STATUS REPORTS

LANCELIN FORESHORE LAND USE AND MANAGEMENT PLAN

Council, at its Meeting of 21 June 2005, considered a comprehensive report in respect to the Lancelin Foreshore Land Use and Management Plan (LFLUMP) and resolved as follows:

“RESOLUTION 05.0121

Moved Councillors Aspinall and Beale that Council:

  1. Receive the “Schedule of Submissions” and endorse the recommended responses in respect to the Lancelin Foreshore Land Use and Management Plan; and

  2. Receive the Lancelin Foreshore Land Use and Management Plan and use it as a reference guide to progress Community and Council initiatives, budget constraints permitting.

A copy of the LFLUMP has been included on Council’s website at www.gingin.wa.gov.au and copies of the Plan and the Schedule of Submissions have been provided to Councillors.

Further, both hard copies and electronic copies of the Plan and Schedule of Submissions are available at both the Gingin Administration Office and Lancelin Sub Office for viewing or for loan.

Correspondence has been forwarded to all submission submittees advising them of the outcome from Council’s Meeting of 21 June 2005 and informing them of where they can access the relevant information.

Further to the above, Council’s 2005/06 Municipal Budget identifies a direct Council contribution of $76,600.00 towards dual use foreshore footpath implementation as per the recommendation in the Plan.

It is envisaged that tenders will be called for the construction of a portion of the Lancelin foreshore dual use footpath in the coming weeks.

STATUS REPORTS

STABLE FLIES

In the previous Information Bulletin Status Report of 5 July 2005, Councillors were advised of an incident whereby stable flies (Stomoxys calcitrans) were found to be attacking newborn lambs on a Karakin property owned by Mr & Mrs D Ottaway.

In order to prevent a similar stable fly outbreak next year, Mrs Jo Ottaway advised Council Staff of her intention to organise a public meeting to form an Action Group consisting of concerned/affected farmers and horticulturists.

Consequently, Council;s Chief Executive Officer (CEO), Mr Simon Fraser, and Principal Environmental Health Officer (PEHO), Mr Wayne Harris, were invited to attend a meeting on Tuesday, 12 July 2005. A Stable Fly Action Group (SFAG) was formed and Office Bearers elected. The SFAG intends holding further public meetings in order to gain local support for this cause. A copy of the Minutes of the meeting as supplied by the Secretary, Mrs Jo Ottaway, are attached as Appendix 1.

In response to correspondence dated 24 June 2005 to the Minister for Health, outlining the serious impact stable fly is having on livestock and lifestyles within the Shire of Gingin, a Meeting was held at the Department of Health on 22 July 2005.

Attendees at the abovementioned Meeting included Officers from the Departments of Health and Agriculture and Local Government Principal Environmental Health Officers. Shire of Gingin representatives included Council’s Shire President, Councillor George Gifford, former Councillor Sally Grant and Council’s CEO, PEHO and Pest Control Officer (PCO). As a result of this Meeting it was recognised that excessive stable fly breeding was occurring in the Shire of Gingin due to the use of raw poultry manure and recommended that the Ministerially appointed Stable Fly Steering Group Committee (SFSGC) be reconvened. It is hoped that in reconvening the SFSGC the Health (Poultry Manure) Regulations, 2004 be amended to extend the ban period to include the months of May and June.

The cooler weather experienced during the month of July has seen a steady reduction in the number of complaints of stable fly affecting livestock and residents within the Shire of Gingin. This reduction is expected to continue if similar weather conditions are experienced during August 2005.

In the period 23 June to 22 July 2005, Council’s PCO has conducted 24 visits to 16 properties and for the same period, six complaints of stable fly activity have been received in the following areas:

GINGIN COAST STRUCTURE PLAN

On 22 July 2005 the Shire President and Chief Executive Officer attended a Meeting of the Gingin Coast Structure Plan Steering Committee (GCSPSC).

The Outcomes of this Meeting, in terms of timelines for the further progression of the Gingin Coast Structure Plan were as follows:

A consolidated Gingin Coast Structure Plan will be prepared by the Department for Planning and Infrastructure and completed by 29 July 2005.

The consolidated Gingin Coast Structure Plan will be forwarded to Council by 8 August 2005 in order for it to be presented to Council for formal consideration at its Meeting of 16 August 2005.

Council’s decision from its Meeting of 16 August 2005 is to be relayed to the Department for Planning and Infrastructure in order for it to prepare a report for consideration by the Western Australian Planning Commission at its Meeting of 27 September 2005.

Subsequent to the Meeting the Shire President, Chief Executive Officer and Consulting Planner have prepared a preferred recommendation for consideration by the GCSPSC as follows:

“RECOMMENDATION

That upon the Shire of Gingin receiving written indemnification from the State Government in relation to the removal of the Guilderton South Urban Development Zone, the Western Australian Planning Commission;

Recommends that the Honourable Minister for Planning and Infrastructure grant final approval to the modified Gingin Coast Structure Plan, as circulated to the Gingin Coast Structure Plan Steering Committee on the 8 August 2005;

Approve the Shire of Gingin Local Planning Strategy subject to the Local Planning Srategy being modified as follows:

In accordance with the Schedule of Modifications as adopted by Council at its Meeting of May 2004;

Deleting the Guilderton South Urban Development area and replacing this with a Recreation and Tourist Node Investigation area;

Deletion of the Rural Living proposal over Lot 3 Wanneroo/Lancelin Road, Gabbadah; and

The Lancelin Townsite Strategic Map at Figure 5 of the Local Planning Strategy being the asterix and note box removed from the Plan.

Recommends that the Honourable Minister for Planning and Infrastructure grant final approval to the Shire of Gingin Town Planning Scheme No 9, subject to the Town Planning Scheme being modified as follows:

In accordance with the Schedule of Modifications as adopted by the Council at its Meeting of May 2004; and

Deletion of the Residential Zone south of Moore River, and replacing this with a Rural Zone.”

Further, Council is in receipt of notes of a Meeting of the Gingin Coast Structure Plan Community Advisory Group held on 22 June 2005. A copy of the notes are attached as Appendix 1.

LANCELIN COASTAL VILLAGE

At the Council Forum of 17 May 2005, Councillor Fullerton advised, that as a member of the Gingin Coast Structure Plan Community Advisory Group, he had received a copy of the Lancelin South Status Report dated May 2005.

A copy of the Status Report from Mr Matthews’ Consultant Planners, Taylor Burrell Barnett, was presented with the Information Bulletin of 7 June 2005.

The Lancelin Coastal Village Structure Plan and rezoning have been progressed via Scheme Amendment No. 84, however, the Western Australian Planning Commission has recommended the Hon. Minister to reject this Scheme Amendment.

Council’s recent submission on the Gingin Coast Structure Plan requested an audience with the Hon. Minister to discuss Scheme Amendment No. 84. To date there has been no response to this request.

Taylor Burrell Barnett, Town Planners, representing the landowner of the Lancelin Coastal Village land, previously advised of a joint venture initiative with LandCorp. It is anticipated that this joint initiative will result in the preparation of an overall Structure Plan which will provide a context and framework for the expansion of Lancelin townsite, including Lancelin South.

Council received a briefing from Taylor Burrell Barnett on 19 July 2005 at which it was indicated they would continue to liaise with LandCorp in respect to Lancelin townsite expansion opportunities.

LANCELIN SEWERAGE INITIATIVE

Council, at its Meeting of 7 June 2005, considered a report prepared in respect to the proposed Lancelin Sewerage Initiative for the northern portion of the Lancelin townsite and resolved as follows:

“RESOLUTION 05.0098

Moved Councillors Manson and Jarvis that Council upon receipt of a further $120,000.00 developer contribution to supplement the existing $58,000.00 developer contributions held in restricted cash, delegate authority to the Shire President and Chief Executive Officer to accept the tender of Mako Civil at a price no greater than $1,354,056.00 (ex GST) plus the equivalent Consumer Price Index increase which has been incurred for the period of 9 March 2005 to the date of acceptance of the tender.

FOR: COUNCILLORS ALDERSON, BEALE, EATON, GIFFORD, JARVIS AND MANSON AGAINST COUNCILLORS ASPINALL, FEWSTER, FULLERTON AND ROE.

CARRIED BY ABSOLUTE MAJORITY (6-4)”

Council is now in receipt of the $178,000.00 developer contribution and, consistent with the abovementioned resolution, staff have convened a meeting with Mako Civil and David Porter Consulting Engineer to discuss the revised tender price. This meeting is scheduled for Friday 29 July 2005. An update, as a result of this meeting, will be provided to Council at its Meeting of 2 August 2005.

Further, correspondence has been received from David Porter Consulting Engineer, forwarding a copy of its latest correspondence from Mako Civil which clearly identifies significant price increases in some components of the tender. The revised costings will form the basis of the discussions at the meeting scheduled for Friday 2 August 2005.

LANCELIN TOWN CENTRE REDEVELOPMENT AND PROPOSED COMMUNITY CULTURAL CENTRE

Council, at its Meeting of 7 June 2005 considered a report in respect to the Lancelin Community Cultural Centre and resolved as follows:

“RESOLUTION 05.0099

Moved Councillors Jarvis and Manson that Council, having regard for the consensus Outcome from its Forum of 17 May 2005:

1. Require the Chief Executive Officer to seek clarification from the Department for Planning and Infrastructure’s Land Asset Management Services Branch, as to the following option in respect to the acquisition of a portion of Reserve 31002, Lancelin, for the purposes of Community/Cultural Centre Development:

A Management Order issued in favour of the Shire of Gingin, with power to lease, for “Community/Cultural Centre” purposes; and

2. Request Hames Sharley Architects to include an additional 100m2 of lettable floor space in the Lancelin Community Cultural Centre design.

AS THE VOTE WAS TIED IN THE FIRST INSTANCE, THE PRESIDING MEMBER, COUNCILLOR E EATON, EXERCISED HER SECOND VOTE IN THE AFFIRMATIVE AND THE MOTION WAS CARRIED.

In accordance with the abovementioned Resolution, Council’s Executive Support Officer advised Hames Sharley Architects of the outcome from Council’s Meeting of 7 June 2005 and requested that an additional 100m2 of lettable floor space be included in the Lancelin Community Cultural Centre concept design.

Further to the above, Councillor Manson and Council’s Chief Executive Officer met with Ms Kylie Coman, Project Manager LandCorp, in Lancelin on Thursday 21 July 2005 to further progress initiatives with respect to the Lancelin town centre and Community Cultural Centre.

STRATEGIC DIRECTION FOR WASTE MANAGEMENT WITHIN THE SHIRE OF GINGIN

In the previous Information Bulletin Status Report dated 5 July 2005, Councillors were advised that Vorina Enterprises Pty Ltd’s Director, Peter Collins, had confirmed that his Company had now purchased land in the south eastern corner of the Shire for the purpose of establishing a Landfill Waste Management Facility.

Vorina Enterprises Pty Ltd Directors had previously requested an opportunity to meet Councillors in order to allow further dialogue and, in particular, outline their proposal to Council in detail. This meeting is to take place at 1.45pm on 6 September 2005 in Council Chambers.

Vorina representatives also advise they are progressing towards Council Planning Approval and Application for Works Approval to the Department of Environment.

BROADBAND PROVISION FOR THE SHIRE OF GINGIN

Council’s Executive Support Officer has received a number of queries in relation to the provision of Broadband in the Shire of Gingin and, in particular, in respect to the actions of Bushcom.

Mr Jamie Robertson, WA Broadband Broker, has been contacted in respect to this matter. Mr Robertson has advised that anyone who has concerns should contact the Telecommunications Industry Ombudsman by telephone on 1800 062 058 or via its website at www.tio.com.au or in writing to PO Box 276 Collins Street West, Melbourne, Victoria 8007.

It is understood that Bushcom currently has a number of service areas registered with the HiBIS Scheme including Donnybrook, Corrigin, Wyalkatchem, Narembeen, Gingin, Quairading, Kambalda, Coolgardie, Rockingham and Busselton, however it is unclear as to whether any such services are actually up and running at this stage.

OCEAN FARM STAGE 2 SUBDIVISION

Council’s Solicitors have had lengthy discussions with representatives of the Department for Planning and Infrastructure’s Country Planning Branch in relation to the Ocean Farm Stage 2 Subdivision.

On 13 July 2005 McLeod’s, Barristers and Solicitors, corresponded with the DPI, a copy of which is attached as Appendix 1.

LANCELIN BACK BEACH ABLUTION FACILITY

Construction of the Back Beach Ablution Facility in Lancelin is progressing well with the brickwork nearing completion.

To date, progress payments of $18,400.00 excluding GST have been paid to the Contractor for the following works:

Concrete footings and slab; Plumbing prelay and septics; and Brickwork.

The total project cost is $54,518.20 including GST.

REVIEW OF WARDS AND REPRESENTATION

In correspondence dated 5 July 2005 the Deputy Chairman of the Local Government Advisory Board (LGAB) confirmed that it had recently considered a report on Councillor to Elector ratios which applied to all Local Governments at the time of the May 2005 elections.

Amendments to the Local Government Act, 1995 (as amended) allows for the LGAB to require a Local Government to carry out a review of its representation at any time. The LGAB recently resolved to require those Councils with Wards outside the accepted Councillor to Elector ratios to undertake a review of wards and representation to address the imbalance prior to the 2007 elections.

The LGAB has confirmed that the Shire of Gingin falls into this category and, therefore, requires that Council undertake a review of wards and representation by 30 June 2006.

The Board encourages Council to commence its review during 2005.

An Agenda Item in respect to this matter will be prepared for Council’s consideration at its Meeting of 16 August 2005.

LAND ACQUISITION - INDIAN OCEAN DRIVE (LANCELIN TO CERVANTES SECTION)

BACKGROUND

In correspondence dated 28 June 2005 Main Roads Western Australia confirmed that it lodged a Taking Order with the Department of Land Information on 7 June 2005 for all land required for the construction of the Lancelin to Cervantes section of the Indian Ocean Drive.

AUSTRALIAN OF THE YEAR AWARDS

Council is in receipt of correspondence dated 14 July 2005 from the Australia Day Council of Western Australia confirming that nominations for Australian of the Year Awards are now open with nominations closing on 29 August 2005.

The nomination categories applicable to the Australian of the Year Awards for 2005 are as follows:

Australian of the Year; Senior Australian of the Year (60 years and over); Young Australian of the Year (16 to 25 years); and Local Hero (Metropolitan & Regional)

RENAMING OF PORTION OF LANCELIN ROAD

BACKGROUND

Council, at its Meeting of 15 March 2005, considered a request from the Department of Land Information Geographic Names Committee (DLI-GNC) in respect to the renaming of a portion of Lancelin Road to Indian Ocean Drive.

As a consequence of its deliberations at this Meeting Council resolved as follows:

RESOLUTION 05.0042

Moved Councillor Kestel that Council:

  1. Accede to the request of Main Roads WA’s Road Asset Planning Branch for the renaming of that portion of Lancelin Road from Gingin Brook Road through to the take-off point of the proposed Lancelin to Cervantes Coast Road connection as “Indian Ocean Drive”, with the portion of existing Lancelin Road from the Indian Ocean Drive take off point through to the Lancelin townsite remaining as “Lancelin Road”; and

  2. In facilitating (1) above, advise Main Roads WA’s Road Asset Planning Branch of its preference for the new designation of Indian Ocean Drive to extend northwards from Breakwater Drive.

In correspondence dated 15 July 2005 the DLI-GNC confirmed recent developments in respect to the renaming initiative.
